Alcanzan FCB y MLB acuerdo para la contratación de peloteros cubanos

La Habana.- LA FEDERACIÓN Cubana de Béisbol (FCB), las Grandes Ligas de Béisbol (MLB, por sus siglas en inglés), con el consentimiento de la Asociación de Jugadores de la MLB (MLBPA), rubricaron hoy un histórico Acuerdo que permitirá que los peloteros cubanos asociados a la FCB, que juegan en la Serie Nacional y en el resto del sistema de competencias de la pelota cubana, puedan ser contratados por cualquiera de los 30 equipos de las Grandes Ligas de Béisbol de Estados Unidos.

El convenio, materializado después de tres años de negociación, asegura una relación de colaboración, estable y no politizada, entre la MLB y la FCB.

En términos generales, sus cláusulas son similares a las establecidas por la MLB con otras ligas foráneas como la Liga Japonesa de Béisbol Profesional (NPB, por sus siglas en inglés); la Liga de la Organización Coreana de Béisbol (KBO)  y la Liga de Béisbol Profesional de Taipei de China (CPBL).

Representa además un modo legítimo y conforme a la práctica internacional, para que los peloteros cubanos puedan jugar sin discriminación, en igualdad de condiciones, en la MLB, sin verse obligados a romper nexos de ningún tipo con su país.

Con aplicación práctica a partir de su firma (19 de diciembre de 2018), el convenio establece que los jugadores cubanos podrán desempeñarse en la liga profesional estadounidense sin perder su residencia en Cuba, ni su vínculo con el béisbol cubano.

Bajo el acuerdo, la FCB deberá liberar a todos los jugadores contratados con al menos 25 años de edad y 6 o más años de experiencia en la Serie Nacional.

La FCB recibirá un pago de una tasa de liberación, totalmente independiente al contrato que logre el pelotero. Adicionalmente, podría liberar jugadores que no cumplan estos requisitos, los cuales serían contratados como amateurs en Grandes Ligas.

El acuerdo aplica también para los jugadores cubanos que hayan emigrado a terceros países para intentar llegar por esa vía a las Grandes Ligas, y que por diversas razones no lo hayan logrado y se reinserten en el sistema competitivo nacional.

Este convenio regulará la relación entre la FCB, la MLB y los jugadores cubanos desde el momento de su firma. Como todo acuerdo, no implica un reconocimiento retroactivo de hechos anteriores. Aplicará exclusivamente a la relación establecida entre estos sujetos desde que comience su aplicación.

El convenio contribuirá a frenar actividades ilícitas como el tráfico de personas, que durante varios años han puesto en riesgo la vida e integridad física de muchos jóvenes talentos del béisbol cubano y de sus familias.           

El acuerdo es un reconocimiento al deporte cubano, en particular a la calidad del sistema de desarrollo de la pelota en Cuba, el cual pese a muchos obstáculos, sigue produciendo jugadores talentosos y apasionados del béisbol.

El convenio forma parte del esfuerzo por continuar fortaleciendo la práctica, el disfrute y el desarrollo del deporte nacional. El acuerdo tendrá un impacto positivo para muchos atletas del país, para los equipos nacionales y la FCB.

FEDERATION AND MAJOR LEAGUES BASEBALL REACH AN AGREEMENT TO SIGN CUBAN PLAYERS

Havana, December 19th, 2018- THE CUBAN Baseball Federation (FCB), the Major Leagues Baseball (MLB), with the consent of the Major Leagues Baseball Players Association (MLBPA) signed a historical agreement today that will allow the Cuban baseball players associated with the FCB, who play in the Cuban National Series and in the rest of the Cuban baseball tournaments system, to be signed by any of the 30 Clubs in the United States´ Major Leagues.

The agreement, materialized after three years of negotiations, guarantees a collaborating relationship, stable and not politicized, between MLB and FCB. In general terms, their legal clauses are similar to those established by the MLB with other foreign leagues such as Japan´s Professional Baseball League (NPB), Korea´s Baseball Organization (KBO), and Chinese Taipei´s Professional Baseball League (CPBL). It also represents a legal conduct adjusted to the international practice for Cuban athletes to play without discrimination, in equal terms, in the MLB, without being compelled to break their ties of any kind with their country.

With a practical application starting from its signing on December 19th, 2018, the agreement states that Cuban players will be able to play in the American professional Leagues without losing their residency in Cuba or their link to Cuban baseball. Under the agreement, the FCB must release all their affiliated players with at least 25 years of age and 6 or more years of experience in the National Series. The FCB will receive from any MLB Club a payment of a “Release Fee”, completely independent of the contract they sign with the player. Additionally, the FCB could release players who do not meet these requirements; they will be signed as amateurs in the Major Leagues instead.

The contract also applies for Cuban players that have migrated to third countries with the purpose of trying to reach the Major League sand that for several reasons haven´t achieved it, they will be able to be reinserted in the Cuban national competitive system.

This agreement will rule the relationship between the FCB, the MLB, and the Cuban players, starting from the moment the accord is signed. Like all agreements, it does not imply a retroactive recognition of prior circumstances. It would exclusively apply to the relationship established between these parties, effective from the moment the agreement is signed.

The contract will contribute to stopping illegal activities like human trafficking that for years have put the physical integrity and life of many talented young Cuban baseball players at risk.

The agreement is an acknowledgement of Cuban sports, mainly of the quality of the development of the Cuban baseball system, which aside many obstacles, is still producing talented and passionate baseball players.

The agreement is part of the effort to continue strengthening the practice, enjoyment, and development of the national sport. This contract will have a positive impact for many athletes of the country, for the national teams, and for the FCB.
